Sweeney Supreme Court justice' 5 "He felt it was his duty to see that the courthouse doors remained open and the little people, who had no power in our society, had just as much protection and opportunity to be heard as the richest and most powerful." Sweeney was a policeman's son, a St.

Ignatius football star and a Canadian football pro. He spoke softly and discreetly, especially in public, and wrote short, sometimes controversial opinions. In his 1997 DeRolph opinion, he "We must ensure that there is enough money that students have the chance to succeed because of the educational opportunity provided, not in spite of it." Sweeney agreed with the fourth, final DeRolph ruling, which reaf-, firmed his first one but basically gave up forcing a reluctant legislature to equalize spending. Pfeiffer said Sweeney wanted to close the case before a new court could overturn the original finding. Big gaps in spending continue today.

For most of his Supreme Court years, Sweeney was considered part of a somewhat liberal Gang of Four with Pfeiffer, Justice Alice Robie Resnick and Justice Andy Douglas. He voted against Republicanbacked laws limiting workers' compensation and insurers' liability. Off the bench, he spoke softly and cheerfully. Chief Justice Maureen O'Connor said Monday, "He was really a gentleman. He was kind.

He was helpful: There was no sense of entitlement. He was grateful to have the opportunity to be a member of the judiciary." A longtime staff attorney, Cheryl Tuttle said Sweeney gave his staff lots of compliments and help. He once sent her home before a snowstorm. Her car broke down. He sent someone to fetch her.

Another staff attorney, Lori Weisman, said he talked up every case's importance. "He kept saying, This is not just about these people. This affects everyone in the Sweeney was raised in Cleveland and played on the offensive and defensive lines at St. Ignatius and Xavier University. He was drafted by the Steelers but followed a Xavier coach to the Ottawa Rough Riders for two years.

He also spent 18 months based at Fort Knox, with the U.S. Army as a company clerk and a touring football player. Back in Cleveland, he worked for the legal department of Allstate Insurance by day and earned a degree by night at Cleveland-Marshall College of Law. He spent seven years as an assistant Cuyahoga County prosecutor. He led an investigation of fixed cases at Cleveland Municipal Court.

In 1970, he won an unexpired term on Cuyahoga's Court of Common Pleas against Republican appointee William J. McCrone. He went on to win full terms. In 1974, Sweeney wrote a letter blasting Ohio's Adult Parole Authority for early shock parole for an armed robber and two heroin peddlers: "It is inconceivable to me that admitted seller of heroin would ever be considered for parole until the minimum sentence of 10 years served." In 1976, he issued his first death sentence, dooming John Johnson to for raping and killing 8-year-old Melissa Hinke. "Hopefully, this sentence would deter others from even thinking about committing a crime such as this," he told The Plain Dealer.

Sweeney lost a bid for the 8th Ohio District Court of Appeals in 1982 and the Supreme Court i in 1986. Then he won an appeals seat 1988 and the Supreme Court in 1992. He became what was then only Supreme Court justice from Northeast Pfeiffer said Sweeney helped paca sometimes testy courthouse. "One time, Andy Douglas and Craig Wright were getting into it a little, Frank, when we were real new, said, 'I don't want to hear any of that. Let's keep the discussion After a hearing about the Dr.

Sam Sheppard murder case, Sweesued the New York Times for million for wrongly reporting in 2000 that he'd been linked to the prosecution in Sheppard's 1966 retrial. The jury forgave the defamation as unintentional. During Supreme Court sessions, Sweeney stayed in a 'hotel in Columbus and kept living in Lakewood.
