And they typically perform these critical services for relatively low pay. What's their reward? Sadly, federal, state and local government employees are often punished at retirement time by Uncle Sam. In return for their years of hard work on our behalf, they. are stripped of a portion of their Social Security benefits. This punishment is called the Government Pension Offset.
Here's how it works. Normally, as the spouse of a retired worker, you're able to claim half of your spouse's Social Security benefits at your retirement. Let's say your spouse's full monthly benefits are: $800. You would normally be entitled to $400, because that's half. But as a government employee, the rules are different.
Uncle Sam says you are entitled to receive retirement benefits from Social Security (based on your spouse's work record) only to the extent that they exceed two-thirds of the amount of your government pension. Here's how the offset works against you: Let's say you worked as a police officer and earned a monthly government pension of $600. Two-thirds of your $600 If your spousal beneArmond fits happen to total Budish $400 (or less), you would end up losing out completely on the spousal Social Security benefits you would normally have received. If your spousal Social Security would have been $500, you would receive only $100. Now let's change the picture just a little bit.
Instead of work-, ing for the city as a police officer, you worked as a security officer for a private company. At retirement, you've earned a. $600 monthly pension from the company. You would get to keep your $600 pension and your entire So-. cial Security benefits of $400 as well.
That's because private pensions don't affect your spousal Social Security benefits. So far I've only been talking about how the Government Pension Offset strips away spousal benefits under Social Security. But there's also another closely related rule, called the Windfall Elimination Provision, that will reduce even your own Social Security benefits at retirement. If you worked for both the government and a private company, perhaps at different times during your life, earning both a government pension and Social Security benefits, your own Social Security benefits are likely to be slashed. Federal legislation Several bills have been introduced in Congress to repeal the Windfall Elimination Provision: In the House: H.R.

Federal service where Social Security taxes are withheld (e.g., Federal Employees Retirement System) will not reduce your Social Security benefits. There's a complicated formula to calculate the reduction, but your Social Security benefits typically will be cut from 5 percent to as much as 60 percent.
For example, let's say you turn 62 this year, after working for a. private company for 20 years with "substantial" earnings. In addition, you worked a number of years for the government. When you reach age 65 and 10 months, you normally would be entitled to your full Social Security retirement benefits of $1,306 per month. But the Windfall Elimination Provision would reduce your Social Security benefits by $306, leaving you with $1,000 per month.
To calculate your specific reduction, you may use Social Security's Online Calculator at www.ssa.gov/retire2/ The Windfall Elimination Provision applies to most, but not all, government workers who don't pay Social Security tax. There are a few exceptions to the provision. You will not lose part or all of your Social Security benefits if: You are receiving survivor benefits following the death of a spouse. You were a federal worker first hired after Dec. 31, 1983.
Your only pension is based on railroad retirement. Your only government work (where you did not pay Social Security taxes) was before 1957. You have 30 or more years of "substantial earnings" in a job covered by Social Security (e.g., a non-government job). Social 1 Security has a table listing the amount of earnings that will be considered "substantial." In 2004, the amount is $16,275. The amount is less for each preceding year.
